MEMBERSHIP AGREEMENT

HOTEL MEMBERSHIP AND ACCOMMODATION AGREEMENT

This Membership and Accommodation Agreement (“Agreement”) is made between Mare Deluxe Residence (“Provider”) and the person creating an account and/or booking accommodation services via the website (“Customer”).

By electronically accepting this Agreement, the Customer agrees to all terms and conditions herein.

1. PARTIES

Customer: Any individual registering through the website.
Personal information is collected through the registration process.

2. SUBJECT OF THE AGREEMENT
This Agreement governs:

  • Customer membership with Mare Deluxe Residence,
  • Online booking of accommodation services,
  • Payment, cancellation, liability, and other legal terms related to such services.

3. MEMBERSHIP AND ACCOUNT CREATION
3.1 Membership Requirements

  • Customers under 18 cannot use the services.
  • All provided information must be accurate, complete, and up to date.
  • Account credentials (username/password) are the responsibility of the Customer.

3.2 Account Misuse

  • Any losses due to unauthorized access are the Customer’s responsibility.
  • Any security breaches must be reported to the Provider immediately.

4. SERVICE DESCRIPTION

  • Accommodation services include room type, date, number of guests, and additional services as shown on the booking page.
  • Information displayed on the booking page (price, date, facilities) is confirmed by the Customer.

5. PRICING AND PAYMENT
5.1 Pricing

  • All prices include applicable taxes.
  • Prices are determined by the Provider and displayed on the website.

5.2 Payment Methods
Customer may pay via:
a) Credit card online,
b) Bank transfer / EFT,
c) On-site payment at the property.

5.3 Payment Confirmation

  • The “Pay Now” or “Pay On-Site” options clearly indicate the payment schedule.
  • Payment secures the reservation.

5.4 Credit Card Security

  • 128-bit SSL and 3D Secure protocols are used.
  • Payment information passes through bank servers only and is not stored by the Provider.

6. BOOKING CONFIRMATION

  • Reservations are confirmed after payment or as approved by the service provider.
  • Confirmation is sent via email or SMS.

7. CANCELLATION AND MODIFICATION
7.1 General Cancellation Policy

Less than 14 days 100% of total fee

7.2 Health / Death Exceptions

  • Official documentation from a public hospital is required for refunds in cases of illness or death of the Customer or first-degree relatives.

8. TERMINATION OF AGREEMENT
8.1 Provider Termination

  • Unjustified termination entitles Customer to compensation.
  • Provider returns all payments within 10 days.

8.2 Force Majeure

  • Natural disasters, war, strikes, terrorism, government orders, technical failures, and other uncontrollable events allow termination or postponement without liability.

9. LIABILITY
9.1 Basic Liability

  • The Provider is responsible for failure to perform obligations under this Agreement.

9.2 Exclusions

  • The Provider is not liable for issues caused by Customer or third-party actions.

10. LUGGAGE AND PROPERTY
10.1 Prohibited Items

  • Items with odor, flammables, explosives, weapons, or animals without explicit written permission are not accepted.

10.2 Loss or Damage

  • In cases of gross negligence by staff, compensation equals 50% of the transportation-related portion of the total booking cost.
  • Written declared valuables are covered up to the total booking cost.

11. CUSTOMER COMPLAINTS AND NOTIFICATIONS
11.1 During Service

  • Any issues must be reported in writing immediately.
  • Continuing to use the service waives claims for compensation related to reported issues.

11.2 Non-Signatory Participants

  • All participants are considered to have accepted this Agreement, even if not signing it.

12. EFFECTIVENESS AND ACCEPTANCE

  • Customer confirms having read and understood pre-information, service details, and pricing.
  • The Agreement becomes effective upon electronic acceptance.
  • The Agreement terminates upon completion or cancellation of the service.

13. JURISDICTION

  • All disputes are subject to Muğla Courts and Enforcement Offices.

14. ACKNOWLEDGEMENT AND COMMITMENT

  • Customer declares to have read, understood, and accepted all terms of this Agreement.
